Brazil/Merck: compulsory license

Merck is not surprisingly none too happy at Brazil's decision to move to issue a compulsory licence in respect of AIDS treatment Stocrin (efavirenz). http://www.pharmabiz.com/article/detnews.asp?articleid=38702&sectionid= There had been discussions but so far these have not reached a mutually acceptable conclusion.

As is well established, TRIPS and the Doha declaration permit compulsory licensing - sometimes. As ever it seems to come down to money, with Merck considering Brazil able to pay more than it is offering: to what extent should a country's (relative?) economic status come into whether compulsory licensing is acceptable.
